Regulatory Challenges and Legal Responses to Autonomous Driving in the Era of Artificial Intelligence

Abstract: Autonomous driving,as a technical reproduction of human driving,maximally bypasses the limitations of human driving through driving algorithms and control logic modeled on human driving.It changes the traditional pattern of driving forms and orders dominated by humans.Autonomous driving,through the technical reproduction of assisting,replicating,and surpassing human driving,replaces the subject of driving,shifts the core scenarios of driving,and alters the regulatory domain of autonomous driving.This has posed a fundamental challenge to the established regulatory frameworks and legal systems.The coexistence and interaction between human driving and autonomous driving have triggered more complex challenges in legal regulation,such as legal access to autonomous driving,the allocation of legal responsibility for autonomous driving offenses,and the security and privacy protection.Therefore,it is necessary to transform the forward-looking predictions and rational previews of autonomous driving in terms of ethics,order,and norms into effective regulatory frameworks and legal norms for the sake of adapting to and promote the orderly development of autonomous driving technology.
